Use of online resources - Copyright & Licensing regulations
Use of online resources is, unless otherwise stated, subject to the
terms of the Copyright, Designs and Patents Act 1988 and associated
Statutory Instruments and the Terms of Use agreed between The Open
University Library and the dataset providers.
When making use of the online resources provided by the Open
University Library, all Library users are also required to comply with
the Eduserv User Obligations and the declaration below:
I agree that my use of online resources made available to me by the
Open University is subject to the following conditions:
1.
I will ensure that all the requirements of the agreements or
contracts under which the online resource is held by the Open
University will be maintained. I acknowledge and agree that data
in these online resources is protected by Copyright Law and that
their use is subject to limitations and by agreements. Details of
agreements and Terms of Use are available on-line or by
application to the Library Helpdesk and I undertake to read these
when I first log in to use specific resources.
2.
I will not remove or alter the Copyright Statement on any copies
of the online resource used by me.
3.
I will ensure the security and confidentiality of any copy
released to me, and will not make any further copies from it or
knowingly permit others to do so, unless permitted to do so under
the relevant licence.
4.
I will use the information derived from the databases only for
purposes defined in the agreement, namely for learning, teaching
or non-commercial academic research undertaken under the auspices
of the Open University.
5.
I will only incorporate the Product, or part thereof, in any work,
program or article produced by me, where this is permitted by the
licence or by "Fair Dealing".
6.
I will only incorporate some part or version of the online
resource in any work produced by me with the express permission of
the Licensor or unless this is permitted under the Agreement.
7.
I will not reverse engineer or decompile the software products or
attempt to do so unless this is explicitly permitted within the
terms of the Agreement for the use of the Product.
8.
I will return or destroy all copies of the Product at the end of
the course / year / period of employment or when requested to do
so.
9.
I will regard any passwords provided as personal to me and I
undertake not to divulge them to a third party. In using online
library resources I realise that the Open University reserves its
right to take legal action against individuals who cause it to be
involved in legal proceedings as a result of violation of its
licensing agreements.
