QUESTIONNAIRE FOR EB1(B) - OUTSTANDING RESEARCHER/PROFESSOR
I. QUALIFICATION AS OUTSTANDING PROFESSOR / RESEARCHER:
The Outstanding Professors and Researcher category has proven to be
one of the most useful methods of sponsoring high-level engineers and
scientists to immigrate to the United States. This category is
reserved for persons who are outstanding in their academic field and
who are recognized internationally as outstanding in that academic
field.
To qualify for this category, we must demonstrate the following:
1.
You are outstanding in an academic field.
2.
You have at least three years of teaching or research in the field
(research or teaching experience gained while working on an
advanced degree can count toward the three-year requirement but
only if the research is recognized as outstanding, or if you had
full responsibility for the courses taught), and
3.
You are offered permanent employment from your employer
To document that you are recognized internationally as outstanding,
you are required to submit at least two of the following:

Documentation of your receipt of major international prizes or
awards for outstanding achievement in the academic field.
*
Documentation of your membership in associations in the academic
field which require outstanding achievements of their members
*
Published material in professional publications written by others
about the alien's work in the field (published material must
include the title, date, and author)
*
Evidence of your participation, on a panel or individually, as the
judge of the work of others in the same or allied academic field.
*
Evidence of your original scientific or scholarly research
contributions to the academic field.
*
Evidence of your authorship of scholarly books or articles in the
scholarly journals with international circulation.

IV. ADDITIONAL PERSONAL DOCUMENTATION NEEDED:
In addition to the documentation requested regarding your
qualifications for being classified as an outstanding
researcher/professor, please provide the following additional
documents:
Copies of all degrees (if not already provided to our office).
Copies of form I-94 for you, your spouse and children (if applicable);
Copies of all passports.
V. APPLICATION PROCEDURES
Once you have provided all of the information to me, I will prepare
all INS forms and write a support letter on behalf of your employer.
Then I will file the visa petition with the Immigration and
Naturalization Service (INS). The processing time is varied for each
INS service center. Please check my website on most recent processing
time for this type of case (I-140). Once the INS approves the
petition, we will then commence processing the application for
permanent residency/immigrant visa through an INS office in the United
States or a U.S. Consulate/Embassy abroad. The processing of this
application is also dependent on whether your priority date is current
for the visa bulletin. At this time, the Category 1 for Employment
Based Visas is current for all countries.
VI. DOCUMENTS REQUIRED FOR THE FINAL STAGE (I-485 ADJUSTMENT OR
CONSULATE PROCESSING)
You must obtain birth certificates for all family members who will be
immigrating with you. If they are not in English, please translate
into English. We will also need a copy of your marriage certificate
and divorce decrees, if you or your spouse were previously married.
